The Human Rights Committee Calls for Inputs for its draft General Comment No. 38 on Freedom of Association

Five years after the adoption of its last General Comment, the Committee calls for inputs from unions, national human rights institutions, civil society, academia and international organizations to develop a new one.

The Human Rights Committee has just published a call for inputs for its draft General Comment No. 38 on article 22 of the International Covenant on Civil and Political Rights on freedom of association.

General Comments are official interpretations issued by the UN Human Rights Committee that clarify the meaning and scope of the rights enshrined in the ICCPR. They guide States and other actors on how these rights should be implemented in practice. Civil society organizations, including NGOs, play a crucial role in shaping these interpretations by submitting evidence, legal analysis, and field-based perspectives during the drafting process. Their engagement ensures that General Comments reflect real-world human rights challenges, address the needs of affected communities, and promote inclusive, practical, and progressive interpretations of international human rights law.

This long-awaited call comes five years after the last adoption of a general comment by the Committee, No. 37, on article 21 on the right of peaceful assembly in 2020.

The Committee calls for input from unions, national human rights institutions, civil society, academia and international organizations to provide relevant information to be taken into consideration by the Committee during the preparation of the first draft. The Rapporteur for drafting the General Comment is Ms. Hélène Tigroudja.

Article 22 of the ICCPR on freedom of association enshrines the following:

1. Everyone shall have the right to freedom of association with others, including the right to form and join trade unions for the protection of his interests.

2. No restrictions may be placed on the exercise of this right other than those which are prescribed by law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others. This article shall not prevent the imposition of lawful restrictions on members of the armed forces and of the police in their exercise of this right.

3. Nothing in this article shall authorize States Parties to the International Labour Organisation Convention of 1948 concerning Freedom of Association and Protection of the Right to Organize to take legislative measures which would prejudice, or to apply the law in such a manner as to prejudice, the guarantees provided for in that Convention.

The deadline for submissions is 19 December 2025, and inputs can be submitted in English, French and Spanish. El Comité de Derechos Humanos acaba de publicar una convocatoria para recabar aportaciones para su proyecto de Observación general n.º 38 sobre el artículo 22 del Pacto Internacional de Derechos Civiles y Políticos relativo a la libertad de asociación.

Las observaciones generales son interpretaciones oficiales emitidas por el Comité de Derechos Humanos de las Naciones Unidas que aclaran el significado y el alcance de los derechos consagrados en el PIDCP. Orientan a los Estados y otros actores sobre cómo deben aplicarse estos derechos en la práctica. Las organizaciones de la sociedad civil, incluidas las ONG, desempeñan un papel crucial en la configuración de estas interpretaciones al presentar pruebas, análisis jurídicos y perspectivas basadas en el terreno durante el proceso de redacción. Su participación garantiza que las observaciones generales reflejen los retos reales en materia de derechos humanos, aborden las necesidades de las comunidades afectadas y promuevan interpretaciones inclusivas, prácticas y progresistas del derecho internacional de los derechos humanos.

Esta tan esperada convocatoria llega cinco años después de la última adopción de una observación general por parte del Comité, la n.º 37, sobre el artículo 21 relativo al derecho de reunión pacífica, en 2020.

El Comité solicita aportaciones de sindicatos, instituciones nacionales de derechos humanos, la sociedad civil, el mundo académico y organizaciones internacionales para que le proporcionen información relevante que pueda tener en cuenta durante la preparación del primer borrador. La relatora encargada de redactar la Observación general es la Sra. Hélène Tigroudja.

El artículo 22 del PIDCP sobre la libertad de asociación consagra lo siguiente:

1. Toda persona tendrá derecho a asociarse con otras, incluido el derecho a fundar sindicatos y a afiliarse a ellos para la defensa de sus intereses.

2. No se impondrán restricciones al ejercicio de este derecho, salvo las prescritas por la ley y que sean necesarias en una sociedad democrática en interés de la seguridad nacional o la seguridad pública, el orden público, la protección de la salud o la moral públicas o la protección de los derechos y libertades de los demás. El presente artículo no impedirá que se impongan restricciones legales a los miembros de las fuerzas armadas y de la policía en el ejercicio de este derecho.

3. Nada de lo dispuesto en el presente artículo autorizará a los Estados Partes en el Convenio de la Organización Internacional del Trabajo de 1948 sobre la libertad sindical y la protección del derecho de sindicación a adoptar medidas legislativas que perjudiquen las garantías previstas en dicho Convenio, ni a aplicar la ley de manera que las perjudique.

Le Comité des droits de l'homme vient de publier un appel à contributions pour son projet d'observation générale n° 38 sur l'article 22 du Pacte international relatif aux droits civils et politiques concernant la liberté d'association.

Les observations générales sont des interprétations officielles émises par le Comité des droits de l'homme des Nations Unies qui clarifient la signification et la portée des droits consacrés dans le PIDCP. Elles guident les États et les autres acteurs sur la manière dont ces droits doivent être mis en œuvre dans la pratique. Les organisations de la société civile, y compris les ONG, jouent un rôle crucial dans l'élaboration de ces interprétations en soumettant des preuves, des analyses juridiques et des perspectives issues du terrain pendant le processus de rédaction. Leur engagement garantit que les observations générales reflètent les défis réels en matière de droits humains, répondent aux besoins des communautés concernées et favorisent des interprétations inclusives, pratiques et progressistes du droit international relatif aux droits humains.

Cet appel tant attendu intervient cinq ans après la dernière adoption d'une observation générale par le Comité, la n° 37, sur l'article 21 relatif au droit de réunion pacifique en 2020.

Le Comité invite les syndicats, les institutions nationales des droits de l'homme, la société civile, les universités et les organisations internationales à lui fournir des informations pertinentes qui seront prises en considération lors de la préparation du premier projet. La rapporteuse chargée de la rédaction de l'Observation générale est Mme Hélène Tigroudja.

L'article 22 du PIDCP sur la liberté d'association stipule ce qui suit :

1. Toute personne a le droit de s'associer avec d'autres, y compris le droit de former des syndicats et de s'y affilier pour la défense de ses intérêts.

2. L'exercice de ce droit ne peut faire l'objet que des restrictions prévues par la loi et qui sont nécessaires dans une société démocratique, dans l'intérêt de la sécurité nationale, de la sûreté publique, de l'ordre public, de la protection de la santé ou de la moralité publiques, ou de la protection des droits et libertés d'autrui. Le présent article n'empêche pas l'imposition de restrictions légales aux membres des forces armées et de la police dans l'exercice de ce droit.

3. Aucune disposition du présent article n'autorise les États parties à la Convention de l'Organisation internationale du travail de 1948 sur la liberté syndicale et la protection du droit syndical à prendre des mesures législatives qui porteraient atteinte aux garanties prévues dans cette convention, ou à appliquer la loi de manière à porter atteinte à ces garanties.
