Overview 110th Session – Kyrgyzstan
The Second Periodic Report of Kyrgyzstan was reviewed by the Human Rights Committee on the 10th and 11th of March 2014. The Deputy Minister of Justice headed the Kyrgyz delegation.
The Human Rights Committee raised an extensive number of human rights abuses in Kyrgyzstan including violence against women, trafficking in persons, ethnic and LGBTI’s discrimination, torture and cruel, inhuman or degrading treatment, impunity, and the lack of registration of newborns in some Uzbek-ethnic populated provinces. Moreover, the Committee expressed its concern about the government’s lack of implementation of the Committee’s Views on individual communications.
Furthermore, after the June 2010 ethnic conflict in the south of Kyrgyzstan, the Committee requested the State to review the legislation governing the state of emergency in order to bring it into compliance with article 4 of the Covenant. The Committee also shared its concerns about the lack of legal justification of certain implemented operations to combat terrorism.
While responding to these concerns, the Kyrgyz delegation stressed its creation of a new legislation to combat trafficking in persons; the role of the National Human Rights Coordination Council; and the fact that LGBTI’s rights is a “new issue” for the State.
The Concluding Observations selected for the follow-up procedure, under which the State should provide information on the implementation of the Committee’s recommendations within one year, are: paragraph 14 on inter-ethnic violence related to the June 2010 ethnic conflict, where the State should take effective measures to investigate all alleged human rights violations; paragraph 15 on the State’s measures to prevent acts of torture and ill-treatment; and paragraph 24 on the State party to ensure individuals to freely exercise their right to freedom of expression.
The next periodic report should be submitted by the 28th March 2018.
