Recommendations

Pursuant to article 2(3) (a) of the Covenant, the State party is under an obligation to provide individuals whose Covenant rights have been violated with an effective remedy, in the form of full reparation.

Accordingly, the State party is obligated to, inter alia, take appropriate steps to:

• (a) inform Ms. Grunova of the exact time of the execution, and of the place of the burial of her son;
• (b) provide Ms. Grunova with compensation for the violations that her son suffered, and for the pain and anguish that she, herself, suffered as a result of her son’s unfair trial and execution.

The State party is also under an obligation to take all steps necessary to prevent similar violations from occurring in the future. In this connection, the State party should review its legislation concerning death penalty as it was applied in the present case.
