Merits

The Committee, acting under article 5 (4) of the Optional Protocol, is of the view that the facts before it disclose a violation by the Russian Federation of articles 19 and 26 of the Covenant

 

Recommendations

the State party is obligated, inter alia, to:

• Take appropriate steps to reimburse the value of the fine paid and any legal costs incurred by the author, as well as to provide appropriate compensation.
• Take all steps necessary to prevent similar violations from occurring in the future
• Ensure that the relevant provisions of the domestic law are made compatible with articles 19 and 26 of the Covenant

Implementation

the Committee wishes to receive from the State party, within 180 days, information about the measures taken to give effect to the Committee’s Views.
