Merits

The Committee acting under article 5(4) of the Optional Protocol, is of the view that the facts before it disclose a violation of Mr. Zaidov's rights under articles 9(1), 14(1), (2), (3)(b) and (e), 19(2) and 22(1) of the Covenant 

Recommendations

The State party is obligated, inter alia:

• To quash Mr. Zaidov's conviction, release him, and if necessary, conduct a new trial in accordance with the principles of fair hearings, presumption of innocence and other procedural safeguards. 
• To provide Mr. Zaidov with adequate compensation
• To take all steps necessary to prevent similar violations from occurring in the future.

Implementation

The Committee wishes to receive from the State party, within 180 days, information concerning the measures taken to give effect to the present Views
