Merits

The Human Rights Committee, acting under article 5(4) of the Optional Protocol to the International Covenant on Civil and Political Rights, is of the view that the information before it discloses a violation by the the State party of articles 14(1) and (3) and 25 of the International Covenant on Civil and Political Rights

Recommendations

the State party is obligated, inter alia, to:

  • Quash the author’s conviction, review the charges against him taking into account the present Views, and, if appropriate, conduct a new trial ensuring all fair trial guarantees 
  • Restore his right to stand for office, including the office of President.
  • Take steps to avoid similar violations in the future, including reviewing its legislation to ensure that any restriction on the right to stand for office is reasonable and proportionate.

Implementation

the Committee wishes to receive from the State party, within 180 days, information about the measures taken to give effect to the Committee’s Views
