Merits

The Human Rights Committee, acting under article 5(4) of the Optional, is of the view that the author's deportation to India would, if implemented, violate his rights under 12(4), and articles 17 and 23(1) of the Covenant

Recommendations

The state party is under the obligation to review the author's case, taking into account the State party's obligation under the Covenant and the Committee's present Views. The State party is also requested to refrain from expelling the author while his case is being reconsidered

Implementation
