Merits

The Committee considers that [...] the removal of the author to Greece would amount to a violation of articles 7 and 24 of the Covenant, read alone and in conjunction with each other.

Recommendations

The State party is required to, inter alia: 

• Proceed to a review of the claim of the author, taking into account the State party’s obligations under the Covenant
• To refrain from expelling the author to Greece while his request for asylum is being reconsidered
