In accordance with article 2 (3) (a) of the Covenant, the State party is under an obligation to provide the author with an effective remedy. This requires it to make full reparation to individuals whose Covenant rights have been violated.
In the present case, the State party is under an obligation to, inter alia,
(a) provide the author with adequate compensation, including for lost earnings and damage to his reputation, legal costs involved in litigation and the violation of his rights as stated in the present Views; and
(b) provide the author with appropriate measures of satisfaction with a view to restoring his reputation, honour, dignity and professional standing, in line with the City Court decision of 16 January 2009.
The State party is also under an obligation to take steps to prevent similar violations from occurring in the future.
