Submission:
In accordance with article 2 (3) (a) of the Covenant, the State party is under an obligation to provide the author with an effective remedy. This requires it to make full reparation to individuals whose Covenant rights have been violated.
Accordingly, the State party is obligated, inter alia, to conduct a new, expeditious, impartial, effective and thorough investigation into the exact circumstances of the author’s son’s death, to prosecute those responsible and to provide the author with adequate compensation and appropriate measures of satisfaction.
The State party is also under an obligation to prevent similar violations in the future, including by removing obstacles for obtaining civil reparation independently of any related criminal proceedings.
