Uruguay: The first country examined under the Human Rights Committee’s new procedure

Uruguay is the first State to be reviewed under the Human Rights Committee’s new ‘List of Issues Prior to Reporting’ (LOIPR) procedure. This new approach to reporting aims to simplify the procedure for States parties by treating the report prepared by the State party in response to the Committee’s List of Issues as the periodic report required under Article 40 of the International Covenant on Civil and Political Rights.

The review of Uruguay by the Committee took place on the 23rd and 24th of October 2013. This review examined Uruguay’s Fifth Periodic Report submitted in response the to Committee’s List of Issues.

The Committee recognised that there had been significant improvements in relation to the implementation of the ICCPR in Uruguay. However, the Committee members expressed concern about the failure to implement the Committee’s decisions on Individual Communications, in particular the case of Peirano Basso v. Uruguay, limitations on the National Human Rights Institution, inequality between men and women in education and employment, the persistence of police abuse which may amount to torture in some cases and the situation of street children.

Of particular concern was the decision by the Supreme Court of Justice in February 2013 that articles 3 and 3 of the Amnesty Law are unconstitutional. This decision opens the door to impunity for crimes committed during the military dictatorship in contravention of human rights norms.

The Concluding Observations selected for the follow-up procedure, under which the State should provide information on the implementation of the Committee’s recommendations within one year, are: paragraph 7 on the National Human Rights Institution; paragraph 8 on the use of preventative detention; and paragraph 19 on the Supreme Court decision to declare unconstitutional various provisions of Law Nº 18.831, relating to reparation for human rights violations under the dictatorship.

The next periodic report should be submitted by the 1st of November 2018.
