Follow-up on Individual Communications

Overview 113th Session – Follow-up to the individual complaints

On 30 March 2015, the Rapporteur on follow-up Views, Mr. Iwasawa, presented his report on the implementation of the recommendations adopted by the Human Rights Committee in relation to individual communications. The report is based on the information related to the individual complaints, setting out all information provided by States parties and authors or their counsel/representative between June 2014 and January 2015.

In that occasion, the complaints were against 16 State parties (Australia, Austria, Azerbaijan, Bosnia and Herzegovina, Cameron, Colombia, Denmark, France, Kazakhstan, Lithuania, Nepal, Republic of Korea, Russian Federation, Spain, Uruguay, and Uzbekistan).

One positive development concerns the step taken by Australia in relation to the case of Horvath (1885/2009). In this case not only the relevant authorities in the State of Victoria apologised and compensated the author, but the State also took the necessary steps to avoid other similar cases. The Committee assessed largely satisfactory (A) the State’s actions in response to that. Also Denmark (2007/2010) and Republic of Korea (1908/2009) received satisfactory assessment for the effective remedies taken including reconsideration of the author’s claims.

Some particular advances were reported with reference to Austria (1454/2006, fully implemented), Bosnia and Herzegovina (1997/2010) and Lithuania (2155/2012).

No progress was noted in relation to several cases (including some very old ones) from Azerbaijan (1633/2007), Bosnia and Herzegovina (1917/2009-1918/2009-1925/2009-1953/2010; 1955/2010), Cameroon (1353/2005; 1813/2008), France (1620/2007; 1760/2008), Nepal (1469/2006; 1761/2008; 1863/2009; 1865/2009), Russian Federation (1304/2004), Spain (2008/2010), and Uruguay (1887/2009). In most of the cases, the Committee decided to continue with the follow-up dialogue.

Finally, the Committee applied grade C to some cases from Colombia (1611/2007), France (1928/2010), Kazakhstan (2024/2011; 2104/2011), and Uzbekistan (1769/2008; 1914-1915-1916/2009), indicating that it considered the implementation of its recommendations unsatisfactory and that the victims had not received reparation.

The CCPR Centre will carry out a more detailed analysis of the report of the Rapporteur on Follow-up to Individual Communications when it is made public in the course of April 2015.
