Merits

The Committee, acting under article 5 (4) of the Optional Protocol, is of the view that the facts before it disclose a violation by the State party of the author’s rights under articles 17 and 26 of the Covenant.

Recommendations

The State party is obligated to, inter alia:

  • Provide the author with adequate compensation 
  • Take steps to avoid similar violations in the future
  • Review its legislation to ensure that it is in compliance with the Covenant, and that mandatory and other coercive forms of HIV/AIDS and drug testing is abolished and, if already abolished, not reintroduced

Implementation

The Committee wishes to receive from the State party, within 180 days, information about the measures taken to give effect to the Committee’s Views
