Merits

The Committee considers that the author has not been granted a fair hearing in accordance with article 14 (1) of the Covenant. Accordingly, the Committee considers that the author’s right under article 14 (1) of the Covenant has been violated.

Recommendations

The State party should therefore ensure, inter alia:

  • That the author has access to judicial proceedings that are in accordance with the guarantees established in article 14 of the Covenant.
  • That the author is awarded appropriate compensation for the violations committed against him according to the present Views.
  • It complies with its obligation to take all steps necessary to prevent similar violations from occurring in the future.

Implementation

The Committee wishes to receive from the State party, within 180 days, information concerning the measures taken to give effect to the present Views
